Her Blood of Birth

“When we don’t understand history, we are doomed to repeat its mistakes” - Michelle Obama writes in her outraged response to the recent SCOTUS ruling and its disregard to women’s choices and human rights in America. 

The history here, lesser understood or overlooked, is linked to the conservative Christian ways of reading and misreading the Bible as God’s literal and biased word. The Bible never mentions abortions or prohibits them, just like the constitution doesn’t. However, biblical laws and attitudes, man-made and male-centric, contain a solid base for sex and body negative approaches, treating women as procreative tools, with little or not disregard for their feelings, choices, needs and voices.  

How we respond to these patriarchal texts, defending or reinterpreting them in ways that reflect social progress and evolution is at the heart of this socio-religious war. And it’s on us who believe in freedom to re-read and challenge these assumptions. It is, and always has been, our responsibility and right to keep the story going, not reading it as a closed book and final fact. Especially the challenging chapters, like this one.

Following the previous lists of laws on forbidden food, chapter 12 contains purity laws that ensure communal living remains holy and holistic, limiting infections or disease, and providing ritual containers that respond to liminal moments in one’s life. This chapter is infamous for its depiction of postpartum rituals, spotlighting the miracle of childbirth, proposing ritual ways to mark new life, yet also perpetuating a male dominated reality that prefers boys to girls and views the woman’s body as a source of ritual pollution. 

Women are instructed to bring an offering to the tabernacle to mark the birth of their children. Once a baby boy is born, the mother is rendered ‘impure’ for 40 days, and only then, after offering the sacrifice, she is once again permitted to the touch. 

The time is doubled if she gives birth to a girl: “If she gives birth to a female she remains impure for two-weeks, like her mensuration period; And for sixty days and six days she is will be in her blood purification period.” (Va 12: 5) 

Why the double time for baby girls, and why is the offering named ‘sin sacrifice’? 

Scholars claim that these postpartum offerings are based on earlier rituals in pagan culture, often brought pre-birth or closely after, to appease local gods and goddesses, and to prevent potential perils during birth and the first few months that follow. The Hebrew priests who appropriated and introduced these laws into Leviticus used previous precedents from local culture and adjusted them to suit their worldview: no more request for help from the divine but a gesture that marks transition and possibly, strangely, transgression. 

The offering of these mothers in postpartum(and there’s no reference to all the other needs or rituals that address the risks, realities and often harsh circumstances surrounding infertility and birth) are named Hatat - Sin-offerings. What’s the sin in giving birth? many have wondered. Some consider it as a technical term related to bleeding during birth, others frame women’s connection to the sin of Eve, the first mother whose desire brought about the suffering of childbirth and the suspicious approach to desire as a whole, often blamed on women.  This is the closest Jewish perspective that is connected to the doctrine of original sin developed later by the church. 

What’s with the double time for giving birth to girls? Some speculations dig deep to prove that this is a deliberate distortion - suggesting that previously on local culture women were not impure post birth - but rather honored and sacred.  The term ‘impure’ designated division, separation - means that she is off-limits to touch - including her husband, preventing sex or performance of public roles. The ‘impure’ status was not sinful but a ‘hand-off’ status, enabling her the time to recuperate and heal, nurse and nurture, excused from roles and duties. The double time following birth of girls meant that the mother was twice-blessed - nurturing the life of another future mother. When patriarchy took over and Leviticus was composed - the time span remained but the reasons for it and the name of the offering were altered to reflect the new patriarchal attitudes- prioritizing males. Women still enjoyed this extra time to recover but the why and what was changed in a cultural shift, over time. 

As people keep making sense of the past it’s on us to reject part of our literary, legal and religious history that don’t celebrate all lives of dignity and to make  new meanings of these ancient texts, just as previous generations did, to challenge the fear-fueled misogamy and celebrate love-based celebration of body and birth, affirming the sacred dimensions of every single expression of life.

האופנים בהם נגיב לנרטיבים הפטריארכליים האלה, נגן עליהם או נתנגד לפרשנות פשטנית ופוגעת הם במרכז המאבק החברתי- דתי הנוכחי. החובה על מי שחפצים בחיים ובחירות לפרש ולעדכן, להתווכח ולהציע פרקים חדשים בסיפור המקראי - בכתב ובעל פה - שישקפו את הערכים המתחדשים של חיינו. התנ״ך עדיין נכתב. והחובה עלינו. כנ״ל בפרק הנוכחי. 

פרק יב, בהקשר חוקי קדושה וטומאה, מתייחס לנוהלים החברתיים שאפשרו קהילה בריאה, מונעת מגיפות וזיהומים, מקדשת חיים, ומייצרת מציאות בה לרגעי חיים מיוחדים עם התייחסות טקסית. הפרק מציין את נוהלי הקרבנות שאמורות אמהות להביא למשכן, לאחר הלידה. ההתייחסות לקדושת הלידה מרגשת פה, אבל ראיית הנשים ביחס לרחם בלבד והעדפה מגדרית של בנים על פני בנות גורמת לפרק הזה להיות בעייתי במיוחד. 

לאם היולדת בן יש 40 ימי טומאה בהם היא אסורה למגע - גם לבעלה. בתום התקופה היא מביאה קרבן חטאת וחוזרת לחיים רגילים. אבל ליולדת בת התהליך כפול: ״וְאִם־נְקֵבָ֣ה תֵלֵ֔ד וְטָמְאָ֥ה שְׁבֻעַ֖יִם כְּנִדָּתָ֑הּ וְשִׁשִּׁ֥ים יוֹם֙ וְשֵׁ֣שֶׁת יָמִ֔ים תֵּשֵׁ֖ב עַל־דְּמֵ֥י טׇהֳרָֽהֿ׃״

למה 80 יום ליולדת בת ומה מהות החטאת  והטומאה הקשורה בלידה מוצלחת? 

מחקרים שונים מראים שיש תקדים מקומי כנעני וחיתי, בו הועלו מנחות וקורבנות לאלוהיות  מקומיות  לפני או מייד אחרי לידה למניעת פגע או מוות. הכהנים שמייצרים את ספר ויקרא עיבדו את הטקסים המקוריים ושינו את המהות - מבקשת סיוע אלהי להודיה וטהרת היולדת. אבל מה בלידה לא טהור?  קרבן חטאת של היולדת מתייחס אולי לדם והפרשות בזמן הלידה שחיברו אותה לסף החיים והמוות. דעות אחרות מזהות בשעת הלידה את החיבור אל החטא הקדמון של חוה - שבשל תשוקתה נענשה בצער הלידה וכך כל הנשים היולדות נגועות בצער ובחטא. זה הכי קרוב שביהדות יש קישור ברור לתיאוריה הנוצרית של החטא הקדמון. 

ולמה 80 יום לבת? יש השערות שבמקור העתיק וקדם פטריאכלי זכתה היולדת למעמד של אלה אחרי לידה, וכפליים אם ילדה אלה נוספת, זוכה לזמן יקר בו היא אסורה לבעלה ולמגע בכלל, פטורה מחובותיה הרגילות כדי להתרכז בבריאותה ובטיפוח הרכה שנולדה. בתרבות שהשתנתה היא עדיין זכתה לזמן המקודש - אבל הסיבות והנסיבות השתנו.  והיום? המאבק לזכות האשה להחליט ולבחור איך  גופה ונפשה, משפחתה ועתידה, דמה וחייה -- עדיין במאבק ובהתהוות לקראת שוויון וצדק. עלינו  שוחרי הצדק החובה לקרוא ולהבין, להתווכח ולדרוש, להמשיך לספר ולתקן את הסיפור הישן שמתחדשת כל הזמן.
